More and more employers are including drug screening as part of their pre-employment/background screening process to ensure that they do not hire an individual with a drug problem.
When deciding on making drug screening a part of your employment screening process it is completely up to you. Certain employers are required to drug screen applicants and employees, however many are not. Take a look at the position you are hiring for. Will the individual be working with children or elderly, have access to prescription medications, operating a company vehicle or heavy machinery? In any of these cases it would be advisable to conduct a drug screen on both applicants and current employees.
Should you decide on implementing a drug screening program you will need to decide if you are going to be screening applicants as part of the pre-employment screening process and/or your current employees as an ongoing random selection process. Once you decide on the program(s) you wish to implement you must adhere to a universal set of rules and screen all applicants and/or all current employees equally and in the same manner. This protects you against you against discrimination laws.
If you are implementing your new drug screening program as part of a pre-employment screening process you will need to obtain written consent from the applicant. Your background screening company should have a release form that you can use for this purpose. If you are implementing a post hire drug screening program this needs to be outlined in an employee handbook or other such documentation, making the employee fully aware they are subject to random drug screening throughout their employment.
The next step is to decide on what type of drug test you would like to administer. The most common is a urine drug screen. However, hair and saliva drug screens are also available. The two most common drug test types are the 5 and 10 panel drug screens. The 5 panel drug screen will test for the “5 basic street drugs”, such as Marijuana, Cocaine, PCP, Opiates, and Amphetamines. The 10 panel will test for these 5 drugs in addition to some common prescription medications. Determining which test to administer is up to you. Again, take a look at the position you are hiring for. If you are hiring a nurse working in a nursing home with access to many prescription medications, it would be advisable to use the 10 panel drug screen.
The main reason for implementing a drug screening process is to protect you and your employees. Given the number of drug users in the US you can see how easily you could hire a habitual drug user without even knowing it, causing problems down the road by stealing drugs, damaging vehicles/equipment and not taking the proper care of children or elderly.

Drug Testing Programs in Schools are measures that teachers and administrators of a school put into place in order to discourage drug use by students. School districts saw widespread implementation of comprehensive Drug and Alcohol policies starting in the mid-1980s. Although small town school districts have generally been slower to adopt these measures, teenage drug use has not spared rural and suburban schools either.
There are many pros and cons in the school drug testing programs. Some say that the main purpose of school drug testing is not to catch kids using drugs, but to prevent them from ever using drugs, illegal or not. Once teenagers are using drugs it is much harder for them to break their addiction. If by testing the athletes or other school leaders, we can get them to say no to drugs, it will be easier for other kids to say no.
Reasons for Student Drug Testing:
· Testing gives students a chance to say “No to Drugs” when approached to use drugs.
· Student drug testing is important because children become addicted more rapidly than adults and their recovery is less likely.
· Students have a right to safe and drug-free learning environments. School administrators need reasonable tools to stop drug users and drug dealers from ruining school for everyone.
· Testing gives parents an opportunity for intervention and treatment. Parents have the right to send their kids to drug-free schools. The thought of sending their kids to a school where drugs are rampant scares parents. Drug testing helps keep our kids safe.
· The intent of this program is not to punish students. The goal is for the drug user to straighten his or her life out. The schools use drug testing as a tool to deter drug use and help students to get drug education and/or counseling. The results are not turned over to law enforcement.
The Supreme Court ruled in 1995 (in Vernonia v. Acton) that schools could randomly test student athletes who are not suspected of drug use. The Court also stated that as school athletes routinely face mandatory physicals and other similar invasions of privacy, they have lower expectations of privacy than the average student. The Court specified that its decision should not be seen as a justification for further expansion of drug testing programs. In 2002 (the Board of Education of Independent School District No. 92 of Pottawatomie County v. Earls) it was ruled in Supreme Court that all students who participate in voluntary activities, like cheerleading, band, or debate, could be subjected to random tests as well.
It’s not a trust issue it’s a health and safety issue. We are talking about kids here. Schools that have drug-testing programs makes atmosphere become more positive. In addition, drug test results are used for counseling purposes and are not turned over to law enforcement.

A drug test is commonly a technical examination to determine the presence or absence of specified drugs or their metabolized traces. Primarily there are five methods of drug testing. Those are
. Urine drug testing: Urine drug test is the most common, inexpensive, simple and easy to administer. Urine drug tests are reliable and can be tested individually and at other places.
. Blood drug testing: Blood testing is one of the most accurate drug testing but intrusive and expensive.
. Hair drug testing: When used in right time hair testing gives more accurate results and it is most expensive drug testing.
. Saliva drug testing: Oral drug testing is the simplest form of drug testing, which is increasingly used, as it is the least intrusive test procedure.
. Sweat drug testing: Sweat tests are patches attached to the skin to collect sweat over a long period of time (10–14 days).
Drug testing, and particularly random drug testing is not allowed in every state in the United States. There are certain guidelines mentioned by The Federal Drug-Free Work Place Act of 1988. Following guidelines give the minimum requirements.
. Publish a policy statement prohibiting unlawful use, possession, manufacture, or distribution of controlled substances in the workplace;
. Notify employees of said prohibition and the penalty for violating it;
. Establish a drug-free awareness program;
. Provide employees engaged in a contract with a copy of the policy statement;
. Notify employees that compliance with the policy statement is a condition of employment;
. Require (in writing in your policy) employees to notify the employer within five
. Days if they are convicted of a criminal drug statute violation occurring in the workplace;
. Make a good-faith effort to maintain a drug-free workplace through these provisions.
In 2004 SAMHSA proposed a new rule that would allow federal agencies to use sweat, saliva and hair in federal drug testing programs that now only test urine. The proposal would also allow selected specimen testing at the time and place it is collected.
Drug testing has an important role in safety-critical and other occupations where the public is entitled to expect the highest standards of safety and probity. In order to make the workforce free from drug use at work places several new methods are in line under the rules proposed by SAMHSA that are unintrusive, inescapable and yield accurate results.

Types of corporate Drug testing: There are different types of drug tests available that are been done at various levels and various circumstances. They are
Pre-Employment Drug testing: The most common type of drug test that can be found at most of the corporations is the Pre-employment drug testing. This type of test is been done to the person at the time of recruitment. Most employers use the standard five-panel test that detects the drugs like marijuana, cocaine, PCP, opiates and amphetamines.
Post Accident Drug Testing: This type of drug testing is conducted after any accident occurs to the employee during the job timings. This post accident drug test is not meant to fire the employee but to protect the company from the liability in the event that the individual is under the influence of the drug that caused the accident. If the drug content is detected in the body, then the company is not obligated to pay for the employee or it is neither obligated to any sort of cases which may effect the company’s goodwill.
Random drug testing: Random drug testing is the procedure where the employees do not know when the tests would be conducted. The frequent and unpredictable random drug testing acts as a deterrent on the employees as they will think twice before taking drugs.
Return to duty/ Follow-up testing: If any employee could not pass the drug test then that person should once again undergo the test with in forty-five days from the test. In that test, the person should get a clearance from the EAP and then he can rejoin the job. After joining, the person will be again tested unannounced and periodically the employee will be tested for six times in the next one year.
Request to retest: The person who has been tested positive for the drugs can apply for the retest, but he should apply only after seventy-two hours after the previous test is been done.
· Reasonable Suspicion Test: If the employee’s behavior or any other observational characters suggests that the person may be impaired due to drugs or alcohol, then both the drug test and the alcohol test would be conducted. If an employee is identified for reasonable suspicion testing, he will be suspended but when the results for the test are negative then he will be again taken in the job and will be paid for the time he has been suspended.
